Agreement to our legal terms

We are KL App Labs Ltd ('Company', 'we', 'us', or 'our'), a company registered in the United Kingdom at 50 Targate Road, Dunfermline, Fife KY12 9FB.

We operate the mobile application Checkmate Chaos (the 'App'), together with related products and services that refer or link to these terms (collectively, the 'Services').

Checkmate Chaos is a chess game and entertainment application combining standard chess gameplay with the Checkmate Chaos character universe. Features may include computer chess, online multiplayer and matchmaking, private games, player accounts, public player names, ratings, rankings and leaderboards, puzzles, Daily Disaster, Survive the Chaos, Chaos Academy, game review, achievements, Chaos Points, character reactions, animations, cosmetic content and optional premium features.

Some features may be used in Guest mode. Registered accounts may use email/password authentication or supported third-party sign-in methods such as Google sign-in. Online, account and progression features may use backend services including Supabase. Purchases and subscriptions may be processed through Google Play Billing and entitlement services such as RevenueCat.

These Legal Terms constitute a legally binding agreement between you and KL App Labs Ltd concerning your access to and use of the Services. By accessing or using Checkmate Chaos, you agree to these Legal Terms. If you do not agree, you must discontinue use.

We may update these Terms to reflect changes to the Services, law, subscriptions, security or our business practices. Where reasonably practicable, we will give notice of material changes. Changes required for security, legal compliance, bug fixes or new functionality may take effect sooner where necessary.

The Services are intended for users who are at least 13 years old. A user who is a minor where they live must have the permission of a parent or legal guardian where required by applicable law.

1. Our services

The Services are provided for personal entertainment, recreation and chess-related learning. Availability of particular modes, characters, rankings, features, subscriptions or online functions may differ by device, account status, region, app version or development stage. Users accessing the Services from outside the United Kingdom are responsible for complying with applicable local laws.

2. Intellectual property rights

KL App Labs Ltd or its licensors owns or licenses the intellectual property in Checkmate Chaos, including its software, source code, databases, designs, artwork, characters, character names, dialogue, text, graphics, animations, sound effects, music, logos, branding, game presentation, website materials and other content ('Content' and 'Marks').

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for personal, non-commercial purposes. Except where permitted by law or expressly authorised by us, you may not copy, reproduce, republish, sell, license, redistribute, scrape, extract, reverse engineer, modify or commercially exploit the App, Content or Marks.

3. Accounts and player names

Certain features require a registered account. You must provide accurate information and keep your account credentials secure. Player names are public identifiers and may be displayed during matches, on leaderboards, rankings, game records and other gameplay surfaces.

Player names must not impersonate others, disclose another person's private information, infringe rights, contain unlawful material, or be used to harass or abuse other users. We may require a player name to be changed or restrict an account where a name breaches these Terms.

Guest mode may be available without a registered account. Guest progress may be stored only on the device and may be unrecoverable if the App is removed, app data is cleared, or the device is lost, reset or replaced.

4. User representations

By using the Services, you represent that you have legal capacity to agree to these Terms; meet applicable minimum-age requirements; will comply with applicable law; will not use the Services for an unlawful or unauthorised purpose; and will not access competitive features through prohibited automated or non-human means.

5. Products and premium features

Checkmate Chaos may offer optional premium subscriptions, cosmetic items, themes, additional characters, expanded game analysis, extra game modes, challenges, enhanced Academy content, additional computer personalities, animations, profile customisation or other digital features. Features may be added, changed, retired or replaced. Purchasing access does not transfer ownership of underlying intellectual property.

6. Purchases and payment

Digital purchases are intended to be processed through Google Play Billing or another authorised app-distribution billing system where offered. KL App Labs Ltd does not directly collect payment card numbers or bank details for Google Play transactions.

You agree to pay the price displayed and confirmed by the applicable billing provider at purchase, including applicable taxes. Prices may be displayed in local currency and vary by territory, taxes, exchange rates, promotions or platform rules.

7. Subscriptions

Where subscriptions are offered, the billing period, price, included benefits and any trial will be displayed before purchase. A subscription may automatically renew until cancelled in accordance with Google Play's applicable rules.

You can manage or cancel an eligible subscription through your Google Play account. Uninstalling Checkmate Chaos does not itself cancel an active subscription. If a free trial or introductory offer is available, its duration and eligibility will be shown at purchase; we do not promise every subscription will include a free trial.

We may change subscription prices or benefits. Where required, advance notice and any required consent will be handled in accordance with applicable law and Google Play requirements.

8. Refunds

Refunds for purchases processed through Google Play are governed by applicable law and Google Play's refund rules and procedures. Nothing in these Terms limits mandatory consumer rights.

9. Software and mobile application licence

We grant you a revocable, non-exclusive, non-transferable, limited licence to install and use Checkmate Chaos on devices you own or control, subject to these Terms and applicable app-distributor rules.

Except where applicable law expressly permits it, you must not decompile, disassemble, decrypt, reverse engineer, derive source code from, modify, adapt, create derivative software from, bypass security within, or redistribute the App.

10. Fair play and prohibited activities

You must not misuse Checkmate Chaos or interfere with fair competition. You must not:

• Use chess engines, bots, scripts, external move-selection tools or other unauthorised assistance during online competitive games.
• Manipulate matchmaking, ratings, rankings, Chaos Points, results, leaderboards, rewards or achievements.
• Deliberately lose, collude, use multiple accounts or arrange games to artificially alter ratings or rewards.
• Exploit bugs, vulnerabilities, timing issues or network behaviour for an unfair advantage.
• Attempt to bypass premium entitlements, subscriptions, security controls, bans or account restrictions.
• Scrape, harvest or systematically collect player names, account data, game data or other Service content without permission.
• Create accounts through automated means or use bots, scripts, cheat utilities or unauthorised automation.
• Harass, threaten, abuse, impersonate or target other players or KL App Labs personnel.
• Upload or transmit malware, malicious code or material designed to disrupt the Services.
• Reverse engineer or modify the App except where applicable law expressly permits it.
• Use the Services for unlawful purposes or infringe another person's intellectual-property, privacy or other legal rights.

11. Online multiplayer, matchmaking and leaderboards

Online multiplayer may match you with other users and display your public player name, rating, ranking, titles, game results and related statistics. Matchmaking quality, opponent availability, latency and connection quality cannot be guaranteed.

Ratings, Chaos Points, ranks, leaderboard positions, titles and rewards are game features and have no cash value unless expressly stated otherwise. We may correct ratings, results, points or leaderboard entries where reasonably necessary to address bugs, cheating, abuse, erroneous calculations or integrity issues.

Players may disconnect, resign, time out or experience connectivity failures. The App may determine results or penalties according to its game rules and server state.

12. User content, player names and feedback

Checkmate Chaos is not intended as a general-purpose user-content publishing platform. Users may nevertheless provide player names, support messages, reports, feedback or other limited submissions.

You retain rights you lawfully hold in material you submit and grant us rights reasonably necessary to receive, store, process, display and use that material to operate, moderate, secure and improve the Services. If you send suggestions or ideas about Checkmate Chaos, you permit us to use that feedback without payment or obligation to implement it.

13. Third-party sign-in and services

Checkmate Chaos may permit sign-in through Google or another supported identity provider. Your use of third-party sign-in is also governed by that provider's terms and privacy practices.

We may use third-party infrastructure and services, including Supabase for account/backend functionality, Google for Google sign-in and Google Play services, and RevenueCat for subscription and entitlement management.

14. Third-party websites and content

The Services may contain links to third-party websites, services or content. We do not control third-party services and are not responsible for their availability, content, security, accuracy or privacy practices.

15. Services management and moderation

We may monitor the Services for compliance with these Terms and take reasonable action to protect users, fair play, our systems and our rights. We may investigate reports, restrict features, remove inappropriate public identifiers, correct rankings, issue warnings, suspend or terminate accounts, or take other proportionate action. Serious or unlawful conduct may be reported to relevant authorities where required or appropriate.

16. Privacy policy

Use of Checkmate Chaos is also governed by the Checkmate Chaos Privacy Policy, which explains how KL App Labs Ltd processes account, gameplay, device, purchase and other information. The Checkmate Chaos Privacy Policy is available at https://klapps.co.uk/checkmate-chaos/privacy.

17. Account suspension, termination and deletion

These Terms remain in effect while you use the Services. We may restrict or terminate access where reasonably necessary because of a material breach, cheating, fraud, abuse, security risk, unlawful conduct or other serious violation, subject to applicable law.

You must not create replacement or deceptive accounts for the purpose of evading a valid suspension or ban.

Registered users may request deletion of their account through the deletion methods provided by Checkmate Chaos and KL App Labs. Deleting an account may permanently remove account-linked progress, rankings, game history and other account data, subject to legal retention requirements and store-managed purchase records.

18. Game data, progress and availability

We may maintain account-linked game data to provide online and progression features. No system is guaranteed against interruption, corruption, deletion or loss.

Guest data stored locally may not be backed up or recoverable. Registered users should not assume every setting, cosmetic, unfinished game or local preference is synchronised across devices unless the App expressly indicates that it is.

19. Modifications and interruptions

We may update, modify, rebalance, suspend or discontinue aspects of Checkmate Chaos, including characters, game modes, puzzles, computer difficulty, rankings, point systems, matchmaking, themes, premium benefits and other functionality.

We do not guarantee uninterrupted or error-free availability. Maintenance, internet failures, server outages, third-party service issues, software defects, device limitations and events outside our reasonable control may affect the Services.

20. Governing law

These Legal Terms are governed by the laws of Scotland. If you are a consumer, mandatory consumer protections and jurisdiction rights applicable in your country of residence remain unaffected where the law requires.

21. Dispute resolution

If you have a complaint or dispute, please contact KL App Labs Ltd first so we can attempt to resolve it. Nothing in these Terms prevents a consumer from using a court, regulator, alternative dispute-resolution body or other remedy available under applicable law.

22. Corrections

Information within the Services may occasionally contain typographical errors, inaccuracies, pricing errors or omissions. We may correct errors and update information, subject to applicable consumer law and platform requirements.

23. Disclaimer

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS. WE DO NOT GUARANTEE THAT CHECKMATE CHAOS WILL ALWAYS BE AVAILABLE, ERROR-FREE, SECURE, COMPATIBLE WITH EVERY DEVICE, OR FREE FROM INTERRUPTIONS.

WE DO NOT GUARANTEE THAT GAME REVIEW, COMPUTER EVALUATIONS, PUZZLE FEEDBACK, COACHING TEXT, RANKINGS OR OTHER CHESS-RELATED OUTPUTS WILL ALWAYS BE COMPLETE OR ERROR-FREE.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LEGALLY BE EXCLUDED, INCLUDING RIGHTS UNDER MANDATORY CONSUMER LAW.

24. Limitations of liability

To the fullest extent permitted by applicable law, KL App Labs Ltd and its directors, employees and agents will not be liable for indirect or consequential losses arising solely from use of or inability to use the Services where such losses were not reasonably foreseeable or where exclusion is otherwise lawful.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law. Your statutory consumer rights are unaffected.

25. Indemnification

To the extent permitted by law, you are responsible for losses or claims caused by your unlawful use of the Services, infringement of another person's rights, or material breach of these Terms. This provision does not require a consumer to indemnify us where doing so would be prohibited or unfair under applicable law.

26. Electronic communications

By using the Services, sending us email, or submitting online forms, you agree that we may provide agreements, notices, disclosures and other communications electronically where legally permitted.

27. Miscellaneous

These Terms, together with policies expressly incorporated into them, constitute the agreement governing your use of Checkmate Chaos. If part of these Terms is held invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Our failure to enforce a provision immediately does not waive our right to enforce it later. We may assign our rights or obligations where legally permitted. No partnership, employment, agency or joint venture is created merely because you use the Services.

28. Chess, game review and coaching disclaimer

Checkmate Chaos may provide chess evaluations, suggested moves, game reviews, puzzles, lessons, computer opponents, hints, ratings or character-based coaching. These features are designed for entertainment and chess learning and may not represent objectively perfect analysis in every circumstance.

Computer strength labels, Chaos ratings, character comments and similar descriptions are entertainment and gameplay features. They are not professional advice and do not guarantee improvement, ranking outcomes or competitive results.

29. Characters, humour and mature content

Checkmate Chaos features fictional characters with exaggerated personalities, humour, reactions, insults or commentary. These characters are entertainment personas and are not intended to represent real people or factual endorsements by KL App Labs Ltd.

Certain optional dialogue or content may contain stronger humour or language and may be subject to age settings, content ratings or user controls. Users and parents or guardians are responsible for considering the applicable store age rating and available content controls.

30. Intellectual property and permitted use

Checkmate Chaos characters, including their visual designs, names, artwork, dialogue, animations and associated branding, remain the intellectual property of KL App Labs Ltd or its licensors. The limited licence granted to users does not permit commercial reproduction, character merchandising, redistribution, extraction of game assets, cloning of the App, or use of our assets to train or build competing products without prior written permission, except where applicable law provides otherwise.

31. Changes to the services

KL App Labs Ltd may modify, suspend, replace or discontinue aspects of Checkmate Chaos where reasonably necessary, including characters, themes, dialogue, modes, rankings, point systems, subscriptions, premium features, online services and pricing. Where a change materially affects a paid consumer entitlement, applicable law and platform requirements will apply.
